Best Best & Krieger LLP Partner Ken MacVey and Of Counsel Wendy Wang authored an article published in the Spring 2023 issue of California Lawyers Association’s Antitrust and Unfair Competition Law journal. MacVey and Wang provide insight on the Cartwright Act, California’s principal antitrust statue, that does not prohibit monopolization which has caused some discrepancies in legal decisions for many years. 

“Citing growing concerns over lack of competition, concentration of market power, and problematic monopolies, the California Legislature adopted Assembly Concurrent Resolution No. 95 in 2022 and approved the California Law Revision Commission to study, among other things, whether California law should be revised to outlaw single-form monopolization.” 

The article provides legislative history of the Cartwright Act, relevant case law and the pending need for California to address monopolization. With California poised to be one of the largest economies in the world, California should implement its own law to address single-form monopolization.
