Ban on Commercial Cannabis Licenses Lifted

Temporary restraining orders imposed on seven businesses that received commercial cannabis licenses from the City of San Bernardino were lifted by a judge, The San Bernardino Sun reported.
 
Best Best & Krieger LLP Partner Jeffrey Dunn and Associate Daniel Shimell are defending the City in litigation that seeks to bar licensing of commercial cannabis businesses that are allegedly  not in compliance with local law or the City’s general plan. A TRO was issued previously but, after hearing from the City’s attorneys Friday, a judge lifted the ban, The Sun reported.
 
Last month, 16 commercial cannabis business licenses were approved — one fewer than allowed by the City. Daniel told the court that the permitting process will continue and there will be opportunities for other businesses to apply for licenses should any of those already approved be found to be out of compliance. In addition, the City could decide to issue more licenses in the future, Daniel noted.
 
“Today, it seems to us that it’s in the public’s best interest to allow the City to go forward with this program to put in place this lawful and regulated cannabis conduct so that we don’t have further activity or more activity on the black market,” Jeff told the court, according to The Sun. “There really needs to be a strong showing of irreparable harm and it really doesn’t exist here.”
