In an in-depth article posted Feb. 23 by the Water Education Foundation, Best Best & Krieger LLP Managing Partner Eric L. Garner discusses the delicate balance of environmental water rights, versus all others, in California. Creating a distinct environmental water right would be “extremely challenging to implement,” Eric said.
“The issue comes down to balancing the tension between the inherent uncertainty and science in these complex ecosystems with the need for entities that deliver water to have certainty in terms of building projects and having certainty of supply for their users,” he said.
