For four decades, since the adoption of the Clean Water Act by Congress, courts, the Environmental Protection Agency and the Army Corps of Engineers have struggled with the definition of “waters of the United States.” The EPA is now poised to adopt its own regulatory definition, based on recent U.S. Supreme Court cases.
