Legal and Policy Considerations of Automated Vehicles: Balancing Innovation and Regulation

Best Best & Krieger LLP attorneys Steven DeBaun and Gregory Rodriguez are co-chairs of The Seminar Group’s “Legal and Policy Considerations of Automated Vehicles: Balancing Innovation and Regulation.” Gregory, as well as Partner Leeann Habte, will serve as moderators during the event, which BB&K is co-sponsoring.

Realizing that “smart” technologies are quickly merging into everyday life, an important focus of the seminar is ensuring local governments are a part of the ongoing conversation around testing and deployment of advanced transportation technologies. Not only will there be focused informative discussions on the important policy and legal foundations needed to support the safe operation of automated vehicles on public roads, but examples of innovative approaches and pilot projects will be presented by staff from public agencies.

The incorporation of such transformative technologies into local governments brings important legal questions that need to be addressed sooner rather than later. Balancing the need to promote innovation within a regulatory framework focused on safety will be critical to the successful deployment of automated vehicles in cities and for promoting public adoption. We encourage public agency staff of any level and the private sector to join this opportunity to have a multi-disciplined and collaborative discussion around the legal and policy considerations associated with the future of transportation.

With the release of the Federal Automated Vehicles Policy, the regulatory discussion around automated vehicles has begun. This session will provide a national update on the legal framework around automated vehicles and will explore the tension between regulation and innovation and what role local governments play. Industry experts and state representatives will also discuss liability issues and how local governments can navigate risks while successfully promoting the testing and use of automated vehicles.

"Insurance Considerations, Privacy and Cybersecurity"
Increased reliance on computers and the rise of the Internet of Things has raised awareness around the important considerations of privacy and cybersecurity and new technologies. Moreover, a world of automated vehicles will likely bring about a new insurance framework. These issues will be considered from both a near- and long-term perspective, and within the new “big data” world we are living in.

"The Path Forward"
A day does not go by without new articles about automated vehicles and the potential benefits and challenges around the adoption of this transformative technology. While there are no perfect answers at this early stage, the interactive discussion from this session will explore the road ahead and the important policy considerations around infrastructure, public outreach and adoption and inclusive access for all citizens, in addition to likely regulatory changes on the horizon.
