AB 52 and its noticing, consultation, and evaluation requirements for tribal cultural resources went into effect in July of 2015. OPR has now issued Appendix G CEQA Guidelines regarding the consideration of tribal cultural resources in CEQA documents. Lead agencies all over California have now had the experience of implementing AB 52: sending out project notices, holding tribal consultations, preparing analyses of potential impact to tribal cultural resources, and adopting mitigation measures aimed at reducing potential impacts to tribal cultural resources prior to project approval. What have we learned? What practices have we developed or, perhaps, learned to avoid? What unexpected issues have arisen? What questions remain unanswered? Let’s talk about where things stand today on the implementation of AB 52.
