Student Rights and Discipline

BB&K assists its school district clients in the day-to-day aspects of public education, including issues surrounding student misconduct, prohibited student activities and disciplinary proceedings. We have drafted disciplinary procedures and policies, including zero tolerance, and advise districts on expulsion procedures. In addition, we have extensive experience on matters relating to the constitutional and statutory rights of parents with respect to instructional materials, class attendance and access to student records. We regularly assist our school district clients with students' rights issues, including rights of privacy, free speech, religious exercise, and other matters relating to the separation of church and state. We also advise school districts in the legal aspects of educational services such as child care programs. We have successfully defended school districts against allegations of racial and sexual discrimination. The firm has gained particular expertise regarding Proposition 227, including attendance at State Board of Education meetings and monitoring the federal litigation.
