BB&K attorneys have years of experience advising districts regarding requests for public records under the Public Records Act. We advise districts about which documents must be disclosed and which are exempt under the Act. We provide responses to Public Records Requests and have successfully litigated cases in which our clients refused to release exempt records. We advise regarding agenda preparation, notices of regular and special meetings, and which matters qualify for closed session and how to notice such items. We have successfully litigated matters regarding the Brown Act, especially protecting closed session matters from disclosure. Our firm represented the California School Boards Association as amicus curiae in Fischer v. Los Angeles Unified School District where the California Court of Appeal agreed with our brief that probationary teachers who were being non-reelected were not entitled to 24-hour notice and a public hearing before the school board. In the areas of conflict of interest and incompatibility of office, we have provided advice to districts regarding the limitations of the law, completion of required State forms, and remedies for violations.
