California faces an increasing political and cultural awareness that we must decrease our demands on non-renewable resources if the current diversity of life is to survive (
EPA Sustainability webpage). This change in the cultural and political landscape has created a growing legal field for BB&K lawyers tracking this change. The BB&K Green Team is comprised of specialists in BB&K’s Environmental and Natural Resources, and Municipal and Redevelopment Law Practice Groups with interest and expertise in areas of law relating to sustainability. The environmental and natural resources lawyers in this cross-disciplinary group have experience throughout California in advising clients in the areas of global warming and climate change, water supply, water quality, stormwater regulation, and related California Environmental Quality Act ("CEQA") compliance. The municipal and redevelopment members of the Green Team advise public and private clients on issues relating to "green" building standards and incentives (including LEED certification), sustainable landscaping standards, public contracts (including "green" building standards and performance requirements), uniform codes, energy procurement and generation, and solid waste and hazardous waste disposal contracts.
Since Governor Schwarzenegger signed the "California Global Warming Solutions Act" (AB 32) into law last year, many California public agencies and private businesses have sought our advice on how to enhance community sustainability in their construction of public works projects, drafting of local building codes, and regulatory compliance. The California Attorney General has clearly stated that CEQA compliance must include analysis of project impacts on climate change and global warming (August 2007 AG Settlement Agreement with San Bernardino County).
