The City of Indio was faced with a number of lawsuits for the condemning of the properties with no payment for the owners and/or relocation. The Mall owner had pulled out of the deal and was refusing to pay the funds needed by the City for the buy-out and to settle the suits brought on behalf of the affected community property owners. The City was left with no alternative but to sue the Mall owner. Best Best & Krieger attorneys Michael Andelson and John Pinkney represented the City in its suit against the Mall and obtained a $17 million dollar judgment in favor of the City Redevelopment Agency. It was an important vindication for the City and its Redevelopment Agency, and provided the City with funds it had lost as a result of damages it sustained to the community and property owners affected by the condemnation.
