Mr. Pinkney is a Partner of Best Best & Krieger LLP and is a member of the Litigation Practice Group. Mr. Pinkney has served as a member of the firm’s Executive Committee and as the former Chairman of the Indian Wells Office Litigation Department.
Mr. Pinkney received his B.A. and J.D. cum laude, from Brigham Young University where he was a member of Phi Delta Phi, Inns of Court, Order of the Barristers and served as Chairman of the Moot Court Program. While in law school, Mr. Pinkney was a member of Brigham Young University’s National Moot Court Team and was a founding member of one of the law schools law journals.
Mr. Pinkney’s work involves handling business and real estate litigation in State and Federal Courts. Mr. Pinkney has handled numerous cases involving real estate disputes. He has also handled contract disputes, business and personal torts, wrongful termination, insurance coverage issues and construction disputes. Mr. Pinkney has handled numerous court and jury trials as well as binding arbitrations.
In addition to his litigation experience, Mr. Pinkney has been active in the local business community. He has served on the board of directors and as president of the local Chamber of Commerce, has served on city commissions, advisory boards for local banking institutions and on the board of directors of several local business and non profit organizations.
In addition to his extensive experience handling business litigation matters, Mr. Pinkney has represented public agencies in large and complex litigation matters. These matters include constitutional rights issues, contract issues and cases involving disputes over large scale redevelopment projects. Mr. Pinkney represented a city client in a complex trial in which his client obtained a $17-million dollar judgment against a developer. The damages awarded to the City were compensation for sales tax revenues the City lost when the developer failed to build a promised retail project within the City.
Recently, Mr. Pinkney obtained $4.5 million for a client that was damaged when a large international retail company breached an operating covenant agreement. Mr. Pinkney also recently obtained a defense verdict in favor of his client who was sued for $27 million for allegedly breaching a contract to sell a large tract of land to a residential developer. Similarly, Mr. Pinkney recently obtained a favorable result for a client who was being sued for $17 million for breach of contract to sell 9 residential subdivisions. Mr. Pinkney also recently won an arbitration involving a claim for specific performance.
Mr. Pinkney has also represented agricultural companies throughout California and has obtained several million dollars in damages for growers that have suffered crop damage due to the actions of third parties. Mr. Pinkney has also successfully defended organic growers in proceedings challenging their standing and certification as organic growers. Mr. Pinkney has successfully handled construction defect cases, intellectual property cases, partnership and corporate disputes and dissolutions and has also successfully represented private companies and interests in pursuing claims against their insurers as well as represented insurance underwriting companies in claims against insurers.
