Labor & Employment Practice

            John Higginbotham is a Partner in the Labor and Employment and Litigation Practice Groups in Best Best & Krieger LLP’s Riverside office.  He practices exclusively in the area of litigation, with a heavy emphasis on employment litigation.  He has successfully represented numerous private and public sector employers, including the cities of Corona, Ontario, Redlands and Colton, the Riverside Unified School District, Fleetwood Enterprises and California Steel Industries in a variety of employment-related claims, including sexual harassment, retaliation, discrimination, wrongful termination, constructive discharge, WARN Act, Title VII, FMLA, ADA, wage and hour, 132a, and breach of contract litigation.

            Mr. Higginbotham joined Best Best & Krieger LLP in 1999 as a first year associate.  He graduated cum laude from Brigham Young University’s J. Reuben Clark Law School in 1999, and concurrently earned a Masters of Business Administration from BYU’s Marriott School of Management.  While in law school, he was a member of BYU’s National Moot Court Team, and was named Best Oralist in the second-year Moot Court competition.  Mr. Higginbotham’s capstone paper in law school focused on same gender sexual harassment liability and the Supreme Court’s decision in Oncale v. Sundowner Offshore Services, Inc.  (1998) 523 U.S. 75.  From May 1996 to May 1998, while in law school, he worked in the corporate legal department of a publicly traded company, where he focused primarily on personnel-related issues.  Mr. Higginbotham also received his undergraduate degree from Brigham Young University, with a major in Economics.

            Mr. Higginbotham is admitted to practice before all the State and Federal trial and appellate courts in the State of California.  He has successfully handled dozens of employment litigation matters in the Superior Courts of Riverside, San Bernardino and Los Angeles counties, in the United States District Courts, and in the California Court of Appeals.  A high percentage of these cases were won on summary judgment or other dispositive motions.  In two such recent cases against a municipal client, Mr. Higginbotham obtained large attorney fee awards against the plaintiffs on post-judgment motions.

            Mr. Higginbotham lives in Riverside with his wife and two children.  He is an active participant and member of the State Bar of California, the Federal Bar Association and the Riverside County Bar Association.  He serves on the Board of Directors of the Riverside County Chapter of the American Red Cross as a member of its executive committee and as chair of its human resources committee.  He also serves as a member of the Board of the Riverside County Bar Association, and as President of the Riverside County Barristers.
