Bankruptcy

Richard Egger is a Partner in the Litigation Practice Group of Best Best & Krieger LLP. His practice areas include Real Estate and Business Litigation, as well as Bankruptcy Litigation. He is the Managing Partner of the firm’s Ontario, California office.

Mr. Egger regularly represents clients in a variety of different types of business cases including corporate governance disputes, and trade secret and unfair competition litigation.  His work in matters involving real estate includes commercial landlord-tenant disputes such as evictions, disputes over exclusive-use provisions, construction disputes and related issues, non-commercial expression at privately-owned shopping centers, as well as other issues related to shopping center operations. He also represents clients on disputes over real estate purchase and sale agreements, development entitlements and approvals, quiet title actions, judicial foreclosures, and the appointment of receivers over operating properties.

Mr. Egger is experienced in representing clients in state court on a variety of creditor remedies such as receiverships, writs of attachment and the like.  He also appears regularly in bankruptcy court, and typically represents creditors and parties who have ongoing contractual relationships with debtors in bankruptcy (usually but not always relating to real estate issues).  He has represented parties purchasing personal and real property from bankruptcy cases, and has represented clients who are defending against preference and fraudulent transfer claims.  In the past, Mr. Egger represented Chapter 7 and Chapter 11 Trustees in liquidation and reorganization cases.

Mr. Egger is a member of several professional organizations such as the American Bar Association (including the Litigation Section and the Real Property, Probate & Trust Section of the ABA), as well as the American Bankruptcy Institute, and the Federal Bar Association.

Mr. Egger was admitted to practice in California in 1992 after graduating from UC Davis Law School. Mr. Egger was a Senior Research Editor of the UC Davis Law Review in 1991-1992.  He graduated with a B.A. in Political Science from the University of California at Riverside in 1989. He is also admitted to practice in all of the Federal District Courts located in California as well as the Ninth Circuit Court of Appeals.
